Terms of service

In this policy, “Donut Watch Co”, “we”, “us” and “our” refers to the Donut Watch Company, a registered brand and trademark under Horologer Ming SA. 

1. Products, Prices and Orders

1. All orders are subject to availability of products and services, payment completion, and acceptance by us or our subsidiaries, authorised agents or partners.

2. We reserve the right to cancel orders for reasons including but not limited to fraud, sanctions, pricing errors, system glitches impacting inventory, and resellers.

3. Product descriptions are only approximate and images are for illustrative purposes only. We make every effort to be as accurate as possible with product descriptions and to display the most accurate colours and references.

4. We reserve the right to update, amend and improve products on an ongoing basis.

5. The order contract is concluded in La Chaux-de-Fond, Switzerland and the language of the contract is English. The contract is governed by the laws of the canton of Neuchatel and any disputes arising out of this contracts shall be under the jurisdiction of the Neuchateloise courts. 

6. Prices and terms vary by regions:

1. For the European Union, prices are in Euros and the displayed price includes VAT and duties

2. For the United Kingdom, prices are in British Pounds and the displayed price includes VAT and duties 

3. For Switzerland and Lichtenstein, prices are in Swiss Francs and the displayed price includes VAT and duties

4. For the United States and rest of the world, prices are in United States Dollars and the displayed price excludes taxes and duties

2. Shipping 

1. Shipping costs:

1. For orders under USD 500 (or equivalent in EUR, CHF and GBP) a shipping charge will be applicable and calculated during checkout

2. For orders of or over USD 500 (or equivalent in EUR, CHF and GBP) we include free, insured, express shipping

2. Customers are responsible for providing the complete and accurate shipping address. Additional charges will be applicable if any buyer requested changes or corrections need to be made to the shipping address after an order is fulfilled and shipped. 

3. We aim to simplify the shipping and delivery process by calculating and collecting all taxes and duties at the time of order. This is shown to you during the checkout process and is intended to save you any surprise expenses during delivery. 

4. Please note that while we ship on Delivered Duty Paid terms and no additional payment will be due upon delivery, you may still be required to submit documentation or identification to your local customs authority via the courier service. Submission of documents and information remains the responsibility of the buyer.

5. Additional shipping charges will be applicable if a shipment is returned to us or requires reshipping due to the customer not submitting documents or information to the courier service or the relevant customs authorities. 

6. We only ship via insured, express courier service such as DHL Express or Fedex.

7. Our shipping estimates are exclusive of public holiday and customs processing times.

8. The shipping service will require a signature or authorisation from the buyer on delivery, at which point responsibility for purchased goods passes to the buyer.

9. The buyer or their appointed representative’s signature on acceptance of the shipment is considered evidence of the date of delivery and fulfilment of the order.

3. Warranty, service and repairs

1. The movement within each Donut comes with a 1-year limited warranty against mechanical defects. Accessories do not include a warranty, unless specifically stated on the respective product page.

2. The warranty starts from the date of delivery and is transferable in the event the watch changes ownership during the warranty period. 

3. Donuts are precision mechanical instruments. Excessive shocks or vibrations, exposure to strong electromagnets and similar activities can cause damage to or affect their functionality. The mechanical warranty does not cover problems due to use out of scope and mishandling. 

4. Donuts are not user serviceable. We cannot guarantee water resistance or mechanical function of the watch if the watch case has been opened or serviced by the customer or an unauthorised third party and doing so will void all warranties.

5. Wear and tear (e.g. water damage to straps, scuff marks to the case or buckle, etc.) is not covered by the warranty. This extends to any external coatings or treatments to the donut case, crown, crystal and buckle.

6. For a warranty claim, we reserve the right to replace the watch or relevant components with something of equivalent, or greater retail value in the event parts are no longer available.

7. Should the owner request a service or repairs outside warranty coverage, the work will be charged depending on scope.

9. For a warranty claim, inbound shipping from the owner to us is at the owner’s cost and responsibility. Return shipping is covered by us. 

10. For out-of-warranty service, both legs of shipping are at the owner’s cost.

4. Returns and cancellations

1. A cancellation applies when an order is cancelled before shipping. A return applies when a product is returned after delivery.

2. Cancellations are possible - please email [email protected].

3. Donuts may be returned provided:

1. they are unused, unworn with all seal intact, and

2. the original packaging and accessories are unused and intact, and

3. we receive the request for a return via email to [email protected] within fourteen (14) calendar days of the watch being delivered, and

4. the watch is handed over to the courier within seven (7) calendar days of us providing shipping details and instructions

4. Return shipping is at the customer’s cost and responsibility. We will not be liable for any damage or loss that occurs during transit. 

5. If a watch does not meet the conditions listed above, we reserve the right to refuse the return or to deduct an amount equivalent to the cost of restoring the donut to brand new condition. 

6. Accessories are considered consumables and are not eligible for returns. All accessory sales are final once shipped.

7. Outside of the fourteen (14) calendar day return period, all sales are final.

8. Refunds, where applicable, will be to the original payment method and in the original transacting currency only.

9. We are not responsible for nor do we have control over the refund of any import taxes or duties paid. These are subject to local regulations and enquiries should be directed to the respective customs authority.

10. Should the item be ineligible for a return or we are unable to accept the return for any reason, we will contact you to have the item shipped back to you at your cost.

5. Liability

1. Our liability is limited only to any loss we cause intentionally or through gross negligence. We are not liable for loss caused by any lesser degree of negligence.

2. We are not liable for loss caused by the people and companies we use to capture, process or fulfil your order, such as payment providers, e-commerce service providers, couriers and so on. This clause does not reduce our duty to deliver your watch, or to refund you if it never arrives.

3. We are not liable for indirect or consequential loss, or for loss of profit, income, resale value, expected increase in value, opportunity or data.

4. If we are liable for anything other than intent or gross negligence, our total liability for an order is limited to the amount you paid us for it.

5. We are not liable for delays or failures caused by events beyond our reasonable control or acts of God.

6. Nothing in these terms limits our liability for our own intent or gross negligence, for death or personal injury where the law doesn't allow that liability to be limited, or for anything else the law doesn't allow us to limit. 

6. Miscellaneous

1. If a part of these terms are deemed unenforceable by a court or prevailing regulations, the remainder of the terms still apply.

2. If we don’t enforce a term or condition right away, we reserve the right to enforce it later.

3. These terms and conditions may transfer to a successor to our business without reducing your rights.

4. We reserve the right to update these terms at our discretion. The latest version will supersede all preceding versions (except for duration of warranty which is fixed at time of purchase).
